On August 20, 2024, a Federal Court Judge in TX ruled that the Federal Trade Commission (FTC) did not have the authority to block all non-competes. Therefore, the FTC Final Rule was struck down, and (for now) non-competition agreements will remain as enforceable as they are today.
We anticipate the FTC appealing this decision, but the September 4th deadline is no longer applicable.
